  •   These rules are designed so that you can familiarize yourself with the privacy policy (hereinafter - Privacy Policy) implemented by SIA "Anteater Search" (hereinafter - ANTEATER SEARCH) on the website https://anteatersearch.com (hereinafter - tmsglobal.eu). 
  •   ANTEATER SEARCH, legal address: Riga, Skolas iela 30-15, LV-1010, registration no. 40203088358, e-mail: [email protected], tel. no. +371 29122320, as the controller of personal data processing on the website tmsglobal.eu, performs data processing and ensures its protection in accordance with the regulatory legislation in force in the Republic of Latvia and the European Union in the field of personal data processing, including the European Parliament and Council Regulation (EU) 2016/ 679 on the protection of natural persons with regard to the processing of personal data and the free movement of such data and which repeals Directive 95/46/EC (General Data Protection Regulation) (hereinafter - GDPR). 
  • Everyone has the opportunity to freely choose - to give or not to give consent to the processing of their personal data on the website tmsglobal.eu, as well as to withdraw their consent easily and conveniently at any time by contacting ANTEATER SEARCH, without affecting the processing carried out up to the moment of withdrawal. Likewise, any person can exercise the data subject's rights stipulated in the laws and regulations in force in the Republic of Latvia and the European Union, including the right to receive information about their data, object to processing, including the use of legitimate interests, as well as submit an application for data correction, deletion, restriction and transfer, give an opinion and request a review of a decision made within the framework of an automated process, as well as, if necessary, submit a complaint to the supervisory authorities regarding personal data processing issues. 
  • • ANTEATER SEARCH confirms that the highest security requirements are met and the privacy of data subjects is maximally protected against personal data that comes into ANTEATER SEARCH's possession. ANTEATER SEARCH invests resources and ensures that personal data is protected in its daily operations. 
  • The purpose of this Privacy Policy is to provide information on how ANTEATER SEARCH processes the personal data of an identifiable natural person - the Data Subject (hereinafter - the Data Subject), which comes to ANTEATER SEARCH's disposal, in cases where the Data Subjects communicate with ANTEATER SEARCH using the available communication channels (data input fields in the respective sections of the tmsglobal.eu website, as well as phone, e-mail, mail), or by visiting the tmsglobal.eu website or visiting ANTEATER SEARCH premises and territory, as well as public events related to ANTEATER SEARCH activities. 
  • The Privacy Policy provides information on how ANTEATER SEARCH obtains personal data on data volumes and data processing terms, on data protection, as well as informs the Data Subject of its rights and obligations and the rules for the use of cookies. 
  • This Privacy Policy applies to every Data Subject whose personal data is processed by ANTEATER SEARCH and is applicable to data processing, regardless of how the data came into ANTEATER SEARCH's possession.  
  • This Privacy Policy has been prepared in a simplified form to introduce issues related to the protection of personal data at ANTEATER SEARCH, but separate definitions are used according to how they are presented in the GDPR: 
  • personal data - any information relating to an identified or identifiable natural person - "data subject". An identifiable natural person is one who can be directly or indirectly identified, in particular by reference to an identifier such as the said person's name, surname, identification number, location data, online identifier or one or more physical, physiological, genetic, spiritual, economic, cultural or social identity factors; 
  • processing - is any operation or set of operations performed on personal data or sets of personal data, with or without automated means, such as collection, registration, organization, structuring, storage, adaptation or transformation, retrieval, viewing, use, disclosure, sending, distributing or otherwise making them available, matching or combining, limiting, erasing or destroying; 
  • controller – is a natural or legal person, public institution, agency or other body that alone or jointly with others determines the purposes and means of personal data processing; 
  • supervisory authority – is an independent public authority established by a Member State in compliance with the requirements of Article 51 GDPR. In the Republic of Latvia, it is the Data State Inspectorate. 
  • In the Privacy Policy, ANTEATER SEARCH has described the measures it has taken to ensure that the interests and freedoms of the Data Subject are protected while ensuring that the data is processed in good faith, lawfully and in a manner transparent to the Data Subject.

Types of personal data 

  • The types of personal data processed by ANTEATER SEARCH depend on the ANTEATER SEARCH services used by the Data Subject or the activities performed by the Data Subject himself. 
  • The most frequently processed data is obtained when the Data Subject receives, or when expressing the desire to receive ANTEATER SEARCH, the services provided by ANTEATER SEARCH: in the "Home", "Our Services" sections and by pressing "Contact Us", choosing the relevant method of communication, e-mail or telephone. In this case, data could be processed: 
  • Person's name, surname; 
  • contact information:

  • Information about the Services received (Opinion of the Data Subject);  
  • Information self-submitted to ANTEATER SEARCH; 
  • If the User makes a complaint about the quality of the Services, ANTEATER SEARCH is obliged to consider such a complaint in accordance with the requirements of the legal acts in force in the Republic of Latvia, which in turn determine the minimum amount of personal data that the complainant must provide in his complaint (name, surname, contact information), along with ANTEATER SEARCH has a legal basis for processing such data and the relevant information is recorded in ANTEATER SEARCH documents and stored accordingly. 

Types of data processing, legal bases, storage terms and access rights 

  • The most common legal grounds for data processing in ANTEATER SEARCH are – data processing for the performance of Services, data processing for the legitimate interests of the manager or a third party, data processing on the basis of the consent of the data subject. 

Data processing to perform the provision of Services

  • When the Data Subject receives the Services on the tmsglobal.eu website, it is considered that a contract has been concluded between ANTEATER SEARCH and the Data Subject. 
  • According to the GDPR, the legal basis for this processing is: 

o Article 6, paragraph 1, subparagraph b) of the GDPR – processing is necessary for the performance of a contract, the contracting party of which is the Data Subject, or for taking measures at the request of the Data Subject before concluding the contract; 

o GDPR Article 6, Clause 1, Clause c) - processing is necessary to fulfill a legal obligation attributable to the controller; 

o GDPR Article 6(1)(f) – processing is necessary to comply with the legitimate interests of the controller or a third party, except if the interests of the data subject or the fundamental rights and freedoms that require the protection of personal data are more important than such interests, in particular if the data subject is a child. 

  • The storage duration of such Data processing is determined in accordance with the purpose of data processing and the requirements of regulatory acts, taking into account the following circumstances: 

o   the term of data storage is defined in the regulatory acts of the Republic of Latvia or the European Union (for example, the "Archives Law", the Law "On Accounting", etc.); 

o  Realization and protection of the legitimate interests of ANTEATER SEARCH and third parties (for example, in the course of legal proceedings, observing the statute of limitations for bringing a claim); 

  • Protection of vital interests, including life and health, of the data subject or other natural person. 
  • With respect to Services provided by ANTEATER SEARCH, which have a fixed time of use of the Services, the information related to these Services is stored throughout this time.Personal data, if there is no legal basis for their processing, is permanently deleted. 
  • Access rights to these data are limited and may be transferred to third parties without the Data Subject's consent in accordance with the requirements of regulatory acts, incl. according to the cases provided for by the GDPR: 

o Law enforcement authorities, a court or another institution, if there is a legal basis to request information, where it is specifically indicated, for what purpose and on what legal basis personal data will be used; 

o third parties with whom ANTEATER SEARCH has concluded an agreement (data processors), provided that such an agreement contains data protection requirements, and the contractual partner undertakes the processing of the Data Subject's data at an equivalent level of security (if applicable); 

o to third parties based on the legitimate interests of ANTEATER SEARCH, which are necessary for the improvement of the Services and the provision of quality Services; 

o To the data subject, upon his written, clear and unambiguous request, identifying the aforementioned person; 

o To a court or other supervisory body, based on the legitimate interests of ANTEATER SEARCH, regarding a person who has violated the legitimate interests of ANTEATER SEARCH. 

•        If the Data Subject objects to data processing for the performance of the contract (if applicable) in cases where mandatory processing of personal data is required, for example, when visiting ANTEATER SEARCH premises, receiving the Services provided by ANTEATER SEARCH, the Data Subject should take into account that ANTEATER SEARCH can prevent the Data Subject from being in ANTEATER in the SEARCH premises, as well as may not ensure the provision of full-fledged and high-quality Services. Also, before concluding any contract (if applicable), ANTEATER SEARCH will need information about the Data Subject, if the Data Subject does not provide such information or has not provided it in full, the Data Subject should take into account that ANTEATER SEARCH may not conclude a contract with the Data Subject and, accordingly, the Data Subject may be denied the opportunity to receive the Services provided by ANTEATER SEARCH. 

Processing of data obtained in the events organized by ANTEATER SEARCH: 

  • For coverage of events organized by ANTEATER SEARCH in the media and on the Internet - ANTEATER SEARCH website tmsglobal.eu may use personal data - video and photo images in which specific persons can be seen and identified. The purpose of posting such videos and photos on the ANTEATER SEARCH homepage is to promote and promote the recognition of tmsglobal.eu. Personal data obtained during events organized by ANTEATER SEARCH and its cooperation partners may be placed on the website tmsglobal.eu, in informational materials, as well as published in the press. 
  • According to the GDPR, the legal basis for this processing is: 

o Article 6(1)(f) GDPR – processing is necessary for the legitimate interests of the controller or a third party, except if the interests of the data subject or the fundamental rights and freedoms that require the protection of personal data are more important than such interests, in particular if the data subject is a child. ANTEATER SEARCH has a legitimate interest in reflecting the events it organizes, or events in which it participates as a participant, in order to promote and ensure the visibility of tmsglobal.eu. 

  • ANTEATER SEARCH has a legitimate interest in attracting public attention and being a recognizable brand for the development of successful commercial activities. 

• In the publication of any information containing personal data, high ethical standards are observed, trying to ensure that the data is used in such a way that the rights and freedoms of the Data Subject are not violated. 

• In the event that the Data Subject has claims against the processing of his personal data based on facts and circumstances of which ANTEATER SEARCH is not informed, he has every opportunity to contact ANTEATER SEARCH and object to the processing of the relevant data. The Data Subject has the right to object to the processing of his data in the events organized by ANTEATER SEARCH, specifically instructing the photographer or video operator not to take photos or video footage of the Data Subject where the Data Subject can be clearly identified, or the Data Subject can avoid being in the photo or video in the frame. However, the Data Subject should take into account that in the case of a large event where there will be a large number of people, it may be difficult for the photographer, video operator or ANTEATER SEARCH to fulfill such a request of the Data Subject or it may not be possible to fulfill it at all, because regardless of this, there will be a legal basis for data processing and it has a defined goal. ANTEATER SEARCH plans to keep this category of data permanently as part of an archive that serves as evidence of the relevant period and serves as historical information for future generations as ANTEATER SEARCH has evolved over time. 

• Recipients of information published by ANTEATER SEARCH events may be third parties, therefore they may be available to an unlimited number of interested parties in the future.

Personal data obtained as a result of incoming and outgoing communication: 

• Within the commercial activity of ANTEATER SEARCH, there is constant communication with various natural and legal persons. Such communication may also contain information about personal data. In cases where the Data Subject has submitted a complaint or request, ANTEATER SEARCH is obliged to provide an answer in accordance with the procedures set out in the current laws and regulations of the Republic of Latvia and the European Union, therefore, it creates circumstances when the Data Subject's personal data is also processed at the same time, such processing is based to the fulfillment of ANTEATER SEARCH's legal obligation. 

• According to the GDPR, the legal basis for this processing is: 

o GDPR Article 6, Clause 1, Clause c) - processing is necessary to fulfill a legal obligation attributable to the controller; 

o GDPR Article 6(1)(f) – processing is necessary to comply with the legitimate interests of the controller or a third party, except if the interests of the data subject or the fundamental rights and freedoms that require the protection of personal data are more important than such interests, in particular if the data subject is a child. 

• ANTEATER SEARCH stores the relevant information for no longer than two years, unless the relevant information is necessary to ensure the protection of ANTEATER SEARCH's legitimate interests for a longer period of time, for example in the case of legal proceedings, or in situations where ANTEATER SEARCH's actions are evaluated by another state supervisory institution. In this case, the personal data of the Data Subject may be stored until the realization of the legitimate interest is completed. 

• Recipients of this personal data can be authorized employees of ANTEATER SEARCH, engaged personal data processors, law enforcement and supervisory authorities, other legal entities in the Republic of Latvia and the European Union in accordance with the procedures specified in the current regulatory acts. 

• If the Data Subject objects to data processing so that ANTEATER SEARCH can provide an answer to the Data Subject's request, in cases where mandatory processing of personal data is required, for example, the Data Subject must take into account that ANTEATER SEARCH will not be able to provide such an answer in substance at all or will have able to provide only partially and inferiorly, depending on the information available to ANTEATER SEARCH about the specific Data subject. 

Consent of the data subject: 

• The data subject can give ANTEATER SEARCH consent to their data processing, the legal basis of which is the data subject's consent according to GDPR requirements. Consent must be informed, provable, in clear and simple language, specific and unambiguous, freely given. Consent can be given in person at ANTEATER SEARCH's legal address or in the relevant section of the tmsglobal.eu website where it is provided. In all other cases, when ANTEATER SEARCH realizes its legal rights by ensuring the requirements set forth in external regulatory acts, consent to the processing of personal data is not required from the Data Subject. 

• The data subject has the right at any time to withdraw the consent given to data processing in the same way in which it was given, this is in person at the legal address of ANTEATER SEARCH or by e-mail: [email protected] and in that case further data processing based on the above given consent for the specific purpose will not be carried out in the future. 

• Withdrawal of consent does not affect data processing carried out at the time when the consent of the data subject was valid (withdrawal of consent does not have retroactive effect). Withdrawal of consent cannot stop data processing carried out on the basis of other legal grounds. 

The following criteria are used to determine the period of storage of personal data: 

• as long as the Data Subject or ANTEATER SEARCH can realize their legitimate interests (for example, processing requests, protecting rights, resolving issues, bringing a lawsuit to court or observing the statute of limitations, etc.) 

• as long as the Data Subject or ANTEATER SEARCH has a legal obligation to store the data. 

Rights and obligations of the data subject 

• The data subject has the right to receive the information specified in the laws and regulations in force in the Republic of Latvia and the European Union in connection with the processing of his data or the restriction of processing in relation to the data subject himself, or the right to object to the processing (including the processing of personal data carried out on the basis of ANTEATER SEARCH legitimate interests). These rights are enforceable to the extent that the data processing does not result from ANTEATER SEARCH's obligations imposed on it by the current regulatory enactments and which are carried out in the public interest. The data subject has the right to: 

  • request ANTEATER SEARCH access to your personal data; 

o receive information about what personal data about him/her is at ANTEATER SEARCH's disposal and what is the purpose of processing this data; 

o what are the categories of recipients of personal data to whom the data was disclosed; 

o information on the period of time for which personal data is stored, or the criteria used to determine said period of time; 

o object to the processing of your data; 

o to data portability (this right allows data subjects to receive personal data provided by the Data Subject to ANTEATER SEARCH in a structured, widely used and machine-readable format and to send said data to another controller, in such a case ANTEATER SEARCH is not obliged to check the quality of the data and make sure of it). 

• If the Data Subject believes that the information held by ANTEATER SEARCH is outdated, inaccurate or incorrect, the Data Subject has the right to request the correction or addition of his/her personal data. 

• The data subject can submit a request for the exercise of his rights in written form: 

  • in person, presenting an identity document (because the Data Subject is obliged to identify himself); 
  • sending the letter electronically via e-mail to [email protected] and signing the request with a secure electronic signature. In this case, it is assumed that the Data Subject has identified himself by sending such a request signed with a secure electronic signature; 
  • using registered mail addressed to the legal address of ANTEATER SEARCH. The response to such a request will be addressed to a specific Data Subject using registered mail, thus ensuring that the letter is received by the relevant Data Subject who is identified upon receipt of the shipment. In case of doubt or suspicion, ANTEATER SEARCH has the right to request additional information from the Data Subject that would allow it to be clearly identified (with the aim of preventing the data from reaching third parties). 
  • ANTEATER SEARCH will send the response to the Data Subject in the form of registered mail to the contact address specified by the Data Subject in a registered letter or electronically to the e-mail address specified by the Data Subject, depending on how the Data Subject wanted to receive the response. 
  • When processing the Data subject's request for the exercise of his rights, ANTEATER SEARCH verifies the identity of the Data subject, evaluates the request and fulfills it in accordance with the legal acts in force in the Republic of Latvia and the European Union. 
  • ANTEATER SEARCH examines data subjects' submissions related to the mentioned rights free of charge. Consideration of the application may be refused or a proportionate fee based on administrative costs may be applied for it, if it is submitted obviously unfounded or excessively, as well as in other cases provided for by the laws and regulations in force in the Republic of Latvia. 
  • The data subject has the right to request the deletion of his personal data or object to its processing if he considers that personal data have been processed unlawfully, or if they are no longer necessary in connection with the purposes for which they were collected and/or processed (implementing GDPR data processing principle "to be forgotten"). 
  • Personal data of the data subject cannot be deleted if the processing of personal data is necessary for one of the following purposes: 

o for ANTEATER SEARCH or a third party to sue, exercise or defend their legitimate interests; 

o to protect the property and copyright of ANTEATER SEARCH; 

o for ANTEATER SEARCH to protect the vital interests of the Data Subject or other natural person, including life and health; 

o creating an archive in accordance with the laws and regulations in force in the Republic of Latvia, which regulate the creation of archives. 

  • The data subject has the right to request that ANTEATER SEARCH limit the processing of the data subject's personal data if at least one of the following circumstances exists: 

o the data subject disputes the accuracy of the personal data - for the period during which the Data Controller can verify the accuracy of the personal data; 

o the processing is illegal and the Data Subject objects to the deletion of personal data and instead requests restriction of data use; 

o The Data Controller no longer needs the personal data for processing, but it is needed by the Data Subject to bring, exercise or defend legal claims; 

o The data subject has objected to the processing in accordance with the GDPR until it has been verified whether the legitimate interest of the Data Controller is not more important than the legitimate interests of the Data Subject. 

• If the processing of personal data of the Data Subject is restricted in accordance with the above-mentioned paragraph of the Privacy Policy, such personal data is processed (does not apply to storage) only with the consent of the Data Subject or for the purpose of defending legal claims or to protect the rights or important interests of other natural or legal persons interests. 

• Before canceling the limitation of personal data processing of the Data Subject, ANTEATER SEARCH informs the respective Data Subject. 

Protection of personal data 

• ANTEATER SEARCH constantly provides and improves data protection measures to protect data of natural persons of Data Subjects from unauthorized access, accidental loss, disclosure or destruction. ANTEATER SEARCH has taken into account the specific risks posed by data processing, in particular the accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access to personal data transmitted, stored or otherwise processed. 

• ANTEATER SEARCH uses appropriate technical and organizational requirements including but not limited to firewalls, intrusion detection, analysis and data encryption software. 

• ANTEATER SEARCH carefully examines all cooperation partners that, with the authorization of ANTEATER SEARCH, process personal data on its behalf, and also evaluates whether the cooperation partners (personal data processors) are able to provide appropriate security measures so that the processing of personal data takes place in accordance with the authorization of ANTEATER SEARCH and to the requirements of binding regulatory acts. 

• ANTEATER SEARCH takes measures to ensure that any person acting under ANTEATER SEARCH and having access to personal data does not process it without ANTEATER SEARCH's instructions, except if the said person is required to do so in accordance with the requirements of regulatory acts. 

• ANTEATER SEARCH ensures compliance with data processing and protection requirements in accordance with regulatory enactments. In the event that a violation of Personal Data Protection has occurred and this could pose a high risk to the rights and freedoms of the Data Subject, as well as there are no exceptions specified in Article 34, Paragraph 3 of GDPR, ANTEATER SEARCH shall notify the Data Subject of the Personal Data Protection violation without undue delay. 

• In case of claims by the data subject, ANTEATER SEARCH will take all necessary steps to resolve the claim through mutual negotiations, but if this fails, the data subject always has the right to appeal to the supervisory authority - the Data State Inspectorate.  

TERMS OF USE OF COOKIES ON THE WEBSITE TMSGLOBAL.EU

  • When using the tmsglobal.eu Website, by notifying tmsglobal.eu users and visitors/Users, cookie technology may be used for the following purposes:

• The data subject has the right to refuse further processing of his/her data at any time, except if there is no other legal basis for data processing or the regulatory acts do not provide otherwise. 

Communication with the Data Subject 

• ANTEATER SEARCH communicates with the Data Subject using the contact information provided by the Data Subject (phone number, e-mail address or postal address). 

• Communication regarding the fulfillment of contractual obligations is carried out by ANTEATER SEARCH on the basis of the concluded contract and in accordance with the contact information specified in the contract (if applicable). 

• In other cases, ANTEATER SEARCH communicates with the Data Subject based on the request submitted by the Data Subject, observing the preferred form of communication indicated by the Data Subject and/or the requirements of regulatory acts.
